FinaCMS does not provide loans, act as a lender, or function as a financial institution.
FinaCMS does not collect, hold, transfer, or manage funds between lenders and borrowers.
All financial transactions occur directly between users and their borrowers.
2. User Eligibility
You must be at least 18 years old to use the platform.
You must operate in compliance with all applicable Indian laws.
You are solely responsible for obtaining any required Money Lending License under applicable State laws.
3. Regulatory Compliance
Users are responsible for complying with State Money Lending Acts and applicable financial regulations.
FinaCMS shall not be liable for regulatory penalties or violations committed by users.
Use of the platform does not grant regulatory approval or financial authorization.
4. Subscription and Fees
Access to FinaCMS is provided on a subscription basis.
Subscription fees may be charged monthly or annually.
Failure to pay applicable fees may result in suspension or termination of service.
All fees are non-refundable unless otherwise stated.
5. Data Protection
Users may input personal and financial data into the platform.
FinaCMS applies reasonable security measures to protect stored data.
Users are responsible for lawful data collection and borrower consent.
FinaCMS does not sell or misuse user data.
6. Prohibited Activities
Using the platform for illegal lending activities.
Charging unlawful or excessive interest rates.
Harassment, abusive recovery practices, or coercion.
Fraudulent financial activities or data misuse.
7. Limitation of Liability
FinaCMS shall not be liable for loan defaults or financial losses.
FinaCMS is not responsible for disputes between lender and borrower.
Maximum liability shall not exceed subscription fees paid in the previous three (3) months.
8. Account Suspension and Termination
FinaCMS may suspend or terminate accounts suspected of illegal or abusive use.
Users may terminate their account at any time.
9. Intellectual Property
All software, branding, and content remain the exclusive property of FinaCMS.
Users may not copy, modify, reverse engineer, or redistribute the platform.
10. Disclaimer
The platform is provided on an "as-is" and "as-available" basis.
FinaCMS makes no guarantees regarding business success or loan recovery outcomes.
11. Indemnification
Users agree to indemnify and hold harmless FinaCMS from claims arising from their lending activities.
12. Governing Law
These Terms shall be governed by the laws of India.
